Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VersyEdu platform, including all related websites, applications, and services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms on behalf of yourself and, where applicable, your school, district, organization, or program.
1. Accounts, Eligibility, and Educational Use
VersyEdu is designed primarily for use by educators, schools, and educational organizations. You may use the Service only if you can form a binding contract with us and are authorized to do so by your institution, where applicable.
If you create an account, you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
2. Acceptable Use
You agree to use the Service only for lawful educational and organizational purposes and in accordance with these Terms. You may not use the Service to post, share, or generate content that is unlawful, harassing, hateful, defamatory, discriminatory, sexually explicit, violent, or otherwise inappropriate for students.
You also agree not to interfere with or disrupt the Service, attempt to gain unauthorized access, reverse engineer the platform, or misuse any APIs, data exports, or security features, except as expressly permitted in writing.
3. User Content and License
You and your institution retain ownership of the content that you and your students submit or upload to the Service ("User Content"). By using the Service, you grant VersyEdu a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify, translate, and create derivative works from User Content solely for the purpose of providing, operating, maintaining, securing, and improving the Service, developing new features (including AI-powered features), and supporting your educational program.
Where applicable, you are responsible for ensuring that you have obtained all necessary permissions and consents (including from students, parents/guardians, or your institution) before submitting User Content. We will not sell User Content, and we will not use User Content to build or improve generalized models for use by other customers in a way that would reasonably identify you, your institution, or individual students, except as permitted by law or by a separate written agreement with your institution.
4. AI and Automated Processing
The Service may use artificial intelligence and machine-learning models ("AI Features") provided by VersyEdu or by third-party providers acting on our behalf. These AI Features may process User Content and usage data to generate suggestions, feedback, scoring, or other outputs, and to help us operate, secure, and improve the Service.
AI outputs may be inaccurate, incomplete, or inappropriate and may reflect biases present in training data. You are responsible for reviewing AI outputs before relying on them, especially in any high-stakes educational or assessment context. The Service and any AI outputs do not constitute legal, medical, psychological, or other professional advice. We may change the AI providers or models we use over time.
5. Data Use, Analytics, and Improvement
We may process account information, technical logs, and usage data (such as pages visited, features used, and interaction patterns) to operate, troubleshoot, secure, and improve the Service. We may also generate aggregate and de-identified analytics about how educators and students use VersyEdu in order to understand engagement, improve features, and inform product decisions.
Where required by law or by your institutional agreement, we will limit our use of student personal information to purposes allowed by that agreement and applicable privacy laws. We may use de-identified or aggregated data derived from User Content and usage to develop and improve algorithms, models, and educational insights, provided that such data does not reasonably identify you, your institution, or individual students.
6. School, District, and Organization Responsibilities
If you are using VersyEdu on behalf of a school, district, or other organization, you are responsible for configuring accounts, managing access, and communicating appropriate expectations and policies to educators, students, and families.
You are also responsible for obtaining any necessary consents or authorizations required by your institution, governing body, or applicable law before using the Service with students.
7. Intellectual Property and Platform Rights
Except for User Content, all rights, title, and interest in and to the Service—including software, design, features, and branding—are owned by VersyEdu or its licensors and are protected by applicable intellectual-property laws.
You may not copy, modify, distribute, sell, or create derivative works from the Service or any part of it, except as expressly permitted by these Terms or with our written permission.
8. Subscriptions, Trials, and Fees
We may offer paid subscriptions, pilots, free trials, or other plans. Unless otherwise stated, fees are non-refundable except where required by law. We may change pricing or features on a prospective basis with reasonable notice.
If you participate in a free pilot or trial, we may limit access or features and may end or modify the pilot at any time. Any transition from a pilot to a paid plan will be documented in a separate agreement or order form.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service, including any AI-powered features, will be error-free, uninterrupted, or perfectly secure, or that it will produce any particular educational outcome.
10. Limitation of Liability
To the fullest extent permitted by law, VersyEdu and its founders, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the Service.
Our total liability for any claim relating to the Service or these Terms is limited to the greater of: (a) the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100), unless a different limit is required by applicable law.
11. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless VersyEdu from any claim, damage, liability, or expense (including reasonable attorneys’ fees) arising from: (a) your misuse of the Service, (b) your violation of these Terms, or (c) your violation of another party’s rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, excluding its conflict-of-laws rules, unless the laws of another jurisdiction are mandatorily applicable. Any dispute relating to the Service or these Terms will be resolved in the courts located in California, subject to any mandatory protections you may have as a consumer under local law.
13. Changes to the Service and Terms
We may update the Service from time to time, including by adding or removing features. We may also modify these Terms to reflect operational, legal, or regulatory changes. For material changes, we will update the “Last updated” date and may provide additional notice in the Service or by email.
Your continued use of the Service after new Terms take effect constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Service.
14. Suspension and Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, pose a risk to other users or to the security of the Service, or if we are required to do so by law or by an institution controlling access to the Service.
